deedzy Terms and Conditions

Welcome to deedzy! These Terms & Conditions (“Terms”) govern your use of our website, services, and platform, including sending, receiving, and redeeming gifts through deedzy.

By using deedzy, you agree to these Terms. If you do not agree, please do not use the platform.

1. Overview of Our Service

deedzy is a gifting platform that lets users send personalized thank-you messages along with digital gifts, physical items, or gift cards.

Senders pre-authorize a payment; the charge only occurs when a gift is accepted.

Recipients may accept, swap, or decline gifts before final payment is processed.

deedzy does not hold or transmit funds — we use third-party payment processors and gift fulfillment partners.

2. User Accounts

You must be 13 years or older to use deedzy. By creating an account, you agree to provide accurate information.

We reserve the right to suspend or terminate accounts for misuse, fraud, or violation of these Terms.

3. Gifting & Pre-Authorization

When you send a gift, a temporary hold is placed on your payment method.

If the recipient accepts or swaps the gift, the payment is captured.

If the recipient takes no action, the hold will expire after a set period (typically 30 days).

If a gift is swapped for a lower-priced item, you are only charged the adjusted amount.

Note: All sales are final once a gift is accepted or redeemed.

4. No Stored Value

deedzy does not store funds, balances, or user wallets. If a gift is declined or unclaimed, no charges are made.

5. Third-Party Partners

Gifts may be fulfilled by external merchants, gift card providers, or affiliate partners.

deedzy is not responsible for issues related to third-party products, services, or redemption failures. Please contact the merchant directly for fulfillment issues.

deedzy earns a commission when you use affiliate gift options—including Amazon and other partners. As an Amazon Associate, deedzy earns from qualifying purchases.

6. Privacy & Data

We respect your privacy. For details on how we collect and use data, see our Privacy Policy.

By using deedzy, you consent to our data practices.

7. Intellectual Property

All content, branding, and technology on deedzy is owned by deedzy Inc. or our partners. You may not copy, modify, or use our IP without permission.

8. Limitation of Liability

deedzy is provided “as is” without warranties of any kind.

To the fullest extent permitted by law, deedzy is not liable for indirect, incidental, or consequential damages related to your use of the platform.

10. Changes to These Terms

We may update these Terms from time to time. We’ll notify you of material changes via email or app notice. Continued use of the platform means you accept the revised Terms.

11. Dispute Resolution & Arbitration

a. Informal Resolution First

Before initiating formal proceedings, you agree to contact us at contact@deedzy.net to try to resolve any dispute informally. We’ll do the same. If we can’t resolve the dispute within 30 days, either party may proceed to arbitration.

b. Binding Arbitration

You and deedzy agree to resolve any claims relating to these Terms or the service through final and binding arbitration, administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.

The arbitration will be conducted in English, by a single arbitrator, and take place in New York County, NY, unless otherwise agreed.

Judgment on the arbitration award may be entered in any court with jurisdiction.

c. Class Action Waiver

You agree to resolve disputes only on an individual basis, and not as part of a class, consolidated, or representative action. The arbitrator may not consolidate more than one person’s claims or preside over any form of a class action.

d. Exceptions

Either party may bring claims in small claims court for qualifying disputes, or seek injunctive or equitable relief for alleged infringement or misuse of intellectual property without first engaging in informal resolution or arbitration.

12. Governing Law

These Terms are governed by and interpreted under the laws of the State of Delaware, without regard to its conflict of law principles.
